The New Email Marketing Rules for Businesses

What is the best tool for a small business to use for marketing and generating new business leads? You probably aren’t going to like my answer.email marketing, computer, blogging, bloggers, small business marketing, business marketing

Believe it or not, it’s email.

I know what you’re thinking right now: email is soooooo 2003.

Email is boring. Email is annoying. Why use email when there are so many new shiny toys for marketing and generating new business, like Facebook and Twitter and texting and something that was invented 15 minutes ago and I haven’t even heard of yet.

But whether you like it or not, there’s a reason email is hot and remains hot.

It’s cheap. It’s effective. It’s easy to use and to scale upwards as your business grows and you as a business owner get busier.

It’s also not going away anytime soon.

How many people do you know who have a Twitter account and use it daily?

How many people do you know who have an email account and use it daily?

Perhaps a better question is how many people do you know who don’t have an email account? (Besides your grandmother; she doesn’t count.)

Email was left for dead, but now it’s back. Email is tanned, rested, and ready.

I know, it’s kind of like saying “Black is the new black” but it’s true.

The problem, however, is you can’t just dive in head first and starting shooting out spam emails to everyone you know.

Because email is not the newest kid on the block, you have to follow what I call:

How to Draft a Demand Letter [Video]

Most legal disputes begin with a simple document that has an even simpler name:  a demand letter.

What is a demand letter, you say?  A demand letter is basically a letter summing up a disputed legal issue, recounting the facts leading up to the dispute, explaining how the dispute caused damage, and asking for a specific outcome.

Lawyers and law firms typically send out demand letters as the first “shot across the bow” at the start of a lawsuit or (hopefully) to avoid a lawsuit entirely.

However, you don’t have to be a lawyer to write a demand letter. You can use a well-crafted demand letter to complain to a restaurant about a bad meal, ask a neighbor to cut back an encroaching tree, or demand payment from a business customer or client.

A well-crafted demand letter can actually avoid litigation by helping two parties that disagree over a contested point to come to agreement over a resolution.

So I put together a video outlining how to draft a demand letter.

Check out the video below and let us hear it in the comments as to what you thought, or if you have any follow up questions.

Is Santa Claus a Criminal?

This is a guest post by Dave Owens.

It’s Christmas season and we all know what that means: Santa Claus will once again engage in various criminal activities.Santa Claus criminal

Poet and transcendentalist Ralph Waldo Emerson said, “Good men must not obey the laws too well.”

While that is an interesting philosophical and moral argument, it is not a legal one.

Santa Claus, though well intentioned, may technically be committing several crimes every Christmas Eve.

Here are just a few of the crimes he is potentially committing:

What You Should Know About Your Cell Phone Privacy in the Digital Age

This is a guest post by attorney Dave Owens.

cell phone, search and seizure, fourth amendment, u.s. constitution, arrest warrant

Zack Morris from Saved by the Bell

We’ve come a long way since the Zack Morris “Saved by the Bell” cell phone. In fact, with the invention of smart phones, cell phones are now essentially a personal computer.

A person’s cell phone often contains personal information (contacts, phone numbers, web sites visited, email correspondence).

Also, with many businesses now equipping their employees with Blackberries, a phone may contain important and confidential work information.

And of course, with photo and video recording capabilities, some people have been known to use phones for a little “private purposes” now and then. Ask Scarlett Johansson how embarrassing it can be if these photos are revealed….

Six Indispensible Tools for a New Business Startup

New Business Resources, dropbox, freshbooks, hostgator, bluehost, clio, It’s not every day you can say this: I haven’t been writing as frequently on this blog as I’d like because I have been busy setting up a new business.

Earlier this year I decided to go out on my own and launch a new law firm, the Corcoran Law Firm.

When you start a new business, you have a million different details to attend to, and a million questions to answer.

From new phone systems to email providers to billing and invoicing software, it seems there are a million choices you need to make.

Fortunately, there are many more options for a new business owner than there were even a couple of years ago. And most of them are better — and cheaper — than ever before.

How to Compare the President to Hitler Without Violating the First Amendment

This is a guest post by attorney Dave Owens. Hank Williams Jr., First Amendment, Free speech, freedom of speech, constitution

For many, Hank Williams, Jr. is synonymous with Monday Night Football.

Even if you were not a fan of Williams or country music in general, you would recognize him from his “Are You Ready For Some Football” introduction that accompanied Monday Night Football every week.

On October 3rd, ESPN decided not to air the introduction after Williams made comments comparing President Obama to Adolph Hitler on Fox & Friends.

Soon afterwards ESPN and Williams officially parted ways. On Williams’ website he claimed that ESPN had “stepped on the toes of the First Amendment.”

While you may agree or disagree with ESPN’s actions, they did not infringe on Williams’ First Amendment rights.

Here’s why:

How to Register a DBA or Fictitious Business Name [Video]

It’s surprising how complicated it can be to pick a name.

There is a lot riding on the choice of a business name, so it’s not a decision to be taken lightly.

Think how many different factors there are to consider – like whether someone else is already using your chosen name, how similar their business is to yours, and whether the name has been trademarked (oh yeah, and you can trademark at both the federal AND the state level).

You even want to consider whether there is a closely matching domain name available for your business blog or website. Why go to the trouble of registering a DBA if you have to pick a domain name that seems completely unrelated?

Not to mention all of the social media accounts you need to register for (we’re looking at you, Qwikster!).

So I prepared a quick video tutorial to show you the exact steps you need to take in order to register a fictitious business name.

Every county has a slightly different system, but this should cover the basics (although it’s by no means comprehensive).

Check it out and leave us a comment below with what you think or if you have any questions.

How to Build a Million Dollar Business by Age 28 with Entrepreneur Trevor Mauch [Audio Interview]

Trevor MauchI recently had the pleasure of interviewing Trevor Mauch, an young guy who apparently never sleeps considering how much he has accomplished at such a young age.

Trevor Mauch is a real estate investor, CEO of a real estate information publishing company, and co-founder of Automize, an automated teleconference and webinar software company.

Even though he wears all these “hats,” his true passion is entrepreneurship, and teaching young people about how to be an effective entrepreneur.

This interview is absolutely packed with savvy advice from a seasoned entrepreneur. Here are some highlights from the interview:

  • How he bought a 4-unit multi-family apartment building when he was 21 years old, still in college, and had only $600 to his name
  • How he learned to develop profitable businesses from the “byproducts” that companies normally discard
  • The importance of surrounding yourself with creative entrepreneurs and professionals
  • How businesses can use automated teleseminars and webinars to generate client leads, save money, and free up company executives to work on business-building activities
  • How the his company profited from giving away content for free
  • How he recently founded an entrepreneurial co-workspace in his hometown
  • Why he thinks everyone should have a “life list” (aka a “bucket list”) of goals to achieve before you die (and why he jumped out of an airplane even though he’s afraid of heights!)

I also included a transcript of the interview below, in case you prefer to read the interview rather than listening to it.

Enjoy!  Please leave comments below the transcript if you have any questions.

Trevor Mauch is CEO of Mach One Media, an online media and publishing company, and co-founder of Automize, an automated teleseminar and webinar company.

How to Raise Capital for Your New Business (While Keeping it Simple)

how to raise money for your businessWhat is the number one reason budding entrepreneurs are prevented from opening a new business?

It’s not lack of skill, or lack of willpower, or even laziness.

It’s money.

It can take a lot of money to start a new business.

Even though technology has steadily driven down the cost of starting a business, there are still dozens of costs involved in launching any new business.

When you start a new business, you need money for buying inventory, hiring staff, purchasing furniture or equipment, leasing space, and you need to set aside income for yourself and your employees as your business ramps up.

A lot of my clients say that the biggest challenge for going to work for themselves was finding a source of the money to get started.

So how can you get money to start a business?
